If a person can convince a court that the imminent broadcast of a report violates their rights and causes them ‘a particularly serious disadvantage’, they can have the broadcast prohibited by means of an interim measure – in urgent cases, even without hearing the editorial team and at very short notice by means of a super-provisional injunction (see Art. 261 ff., in particular 265 and 266 Civil Procedure Code).

If such a measure is announced or issued, the senior editorial management or those responsible for the programme must be informed immediately. Where a ban is foreseeable, the legal department must be consulted at an early stage.

If a court has issued a super-provisional injunction against the broadcast of a report, we must comply with it. Deliberate disregard of the ban can only be considered in extreme cases.

In any case, it must be approved by the department management or the senior editorial management.
